On the matter being taken up, learned A.G.A. pointed out that in paragraph no. 22 of the affidavit, filed in support of this bail application, the applicant has mentioned that he has no criminal history except the present case, whereas, apart from this case, applicant-Azeem has a criminal history of following five cases :- (i) Case Crime No. 1011 of 2017, U/s 323, 504, 506 I.P.C., P.S. Kasganj, District Kasganj. (ii) Case Crime No. 285 of 2023, U/s 21/22 NDPS Act, P.S. Kasganj, District Kasganj. (iii) Case Crime No. 359 of 2023, U/s 2/3 U.P. Gangster Act, P.S. Kasganj, District Kasganj. (iv) Case Crime No. 199 of 2025, U/s 303(2), 317(2) B.N.S., P.S. Sikandarpur Vaish, District Kasganj. (v) Case Crime NO. 287 of 2025, U/s 303(2) B.N.S., P.S. Patiyali, District Kasganj. In response, learned counsel for the applicant submits that the applicant may be permitted to withdraw the instant bail application with liberty to file fresh bail application with better particulars. Learned A.G.A. has no objection to such prayer of learned counsel for the applicant. In view of the above, the instant bail application is dismissed as not pressed with liberty as prayed for.
