ORAL ORDER
This petition is filed by petitioners -accused Nos.1 and 2 under Section 483 of BNSS praying to grant bail in Crime No.54/2025 of Robertsonpet Police Station registered for offences punishable under Sections 351(3), 109, 352, 351(2), 3(5) of BNS.
2. Heard learned counsel for petitioners and learned Additional SPP for the respondent -State.

Learned counsel for petitioners would contend that there was rivalry between petitioner and the injured. The injured has sustained only one injury on his left hand and it is stated to be simple injury. The charge sheet has

been filed and therefore, petitioners are not required for custodial interrogation. Petitioners are in judicial custody since 31.05.2025. The victim is a rowdy sheeter. With this, he prays to allow the petition and grant bail to petitioners. 4. Per contra, learned Additional SPP for the respondent -State would contend that C.W.2 -injured has sustained one injury on his thumb and it is stated to be simple injury. There is a serious overtact is alleged against these petitioners –accused Nos.1 and 2 assaulting C.W.2 with knife. Charge sheet materials show prima facie case against petitioners for offences alleged against them. With these, she prayed for dismissal of the petition. 5. Having heard learned counsels, this Court has perused charge sheet and other materials placed on record. 6. As per charge sheet, the case of prosecution is that on 30.05.2025 at about 04.40 p.m. when C.W.2 was purchasing water bottle, at that time accused Nos.1 to 3

came in a car and abused. Again, accused No.1 abused C.W.2. in Tamil language and in turn C.W.2 also abused accused No.1. At that time, accused No.1 took knife and got down from the car. When C.W.2 started running, accused No.2 also got down from the car and they chased C.W.2. Then, accused No.1 assaulted C.W.2 with knife on his head and caused bleeding injury and accused No.2 assaulted C.W.2 on his left thumb and caused bleeding injury and accused Nos.1 to 3 went in the car. Even though there is overtact of assault with knife on the head, no injury is forthcoming on the head of C.W.2. The injury which is stated to have been sustained by C.W.2 is a cut lacerated wound on his left thumb. The said injury is stated to be simple in nature. Petitioners are in judicial custody since 31.05.2025 and as the charge sheet is filed, they are not required for custodial interrogation. There are no criminal antecedents of petitioners. Considering the above aspects, petitioners have made out case for grant of bail with conditions.

7. In the result, the following
ORDER i) The petition is allowed. ii) Petitioners are granted bail in Crime No.54/2025 of Robertsonpet Police Station subject to following conditions; a) Petitioners –accused Nos.1 and 2 shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of jurisdictional Court. b) Petitioners –accused Nos.1 and 2 shall not tamper the prosecution witnesses either directly or indirectly. c) Petitioners –accused Nos.1 and 2 shall attend the trial Court on all dates hearing unless exempted and co-operate for speedy disposal of the case.

d) Petitioners –accused Nos.1 and 2 shall not involve in commission of any offence, if they commit any offence, then the prosecution is at liberty to seek cancellation of their bail.
