(ORAL) The present writ petition has been filed for seeking setting aside of the order dated 04.08.2025 (Annexure P-12) whereby the application of the petitioner for resignation has been rejected by the respondents. 2 Learned counsel appearing on behalf of the petitioner contends that the petitioner is ready and willing to deposit the amount as per the bond furnished by him, however, notwithstanding the same, the respondents have rejected the resignation of the petitioner on the ground that there is a shortage of Radiologist in the Department. He submits that the same is violative of the rights of the petitioner and he cannot be compelled to work against his wishes RAJ KUMAR ARORA 2025.08.12 18:47 I attest to the accuracy and integrity of this document CWP-23109-2025 (O&M). -2- notwithstanding that he complies with the condition of payment of the bond money to the respondent-State. 3 Learned State counsel has referred to Memo No.54/M (1351)- 3E4/2025 dated 11.08.2025, received by the office of Advocate General, Haryana, from the Director General Health Services, Haryana, wherein it has been conveyed that the case of the petitioner for acceptance of his resignation is being proposed and forwarded to the Government for its approval and the same shall be accepted within a period of one month. 4 In view of the aforesaid, the present writ petition is disposed of as having been rendered infructuous. The respondents are directed to abide by the timeline as conveyed to this Court within which the resignation of the petitioner shall be finally accepted. 5 At this stage, counsel for the petitioner contends that since the petitioner is discharging his functions, till the resignation is accepted, the respondents be directed to release the salary for the said period. 6 Needless to mention that the needful shall be done by the respondents and the admissible payable salary of the petitioner shall not be withheld for no valid reasons.
