BEFORE HONOURABLE MR. JUSTICE PARTHIVJYOTI SAIKIA ORDER Date : 10.03.2025 Heard Mr. Azad Ahmed, the learned counsel appearing for the petitioner. Also heard Mr. D.P. Goswami, the learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 483 of the BNSS, 2023, whereby the petitioner, Rose Ali has prayed for releasing him on bail after he was arrested in connection with Chandmari P.S. Case No. 20/2025. 3. Some particular persons purchased motorcycles on being financed by L&T Finance Company. They did not repay the loan. In fact, they disappeared. Suddenly, on one particular
Page No.# 2/2 day, the officials of the Finance Company saw those persons at Adabari locality. One of them, namely, Gobinda Baishya was detained. Others managed to run away. The officials of the Finance Company came to know that those persons sold the motorcycles to different persons in Bangladesh and Meghalaya. 4. The present petitioner was also arrested in this case on the ground that he failed to repay the loan. 5. Mr. Ahmed submits that the petitioner was never a part of the crime as alleged in the FIR. The petitioner claimed that he took loan but failed to repay the same. 6. Mr. Goswami submits that the present petitioner was partly involved in the crime as alleged in the FIR. 7. Mr. Ahmed submits that the petitioner is ready to pay the instalments to the L&T Finance Company. 8. The petitioner has already spent 33 days in judicial custody. 9. I have considered the submissions made by the learned counsel of both sides. 10. Since the petitioner is ready to pay the instalments, the bail application of the petitioner is allowed. 11. It is hereby directed that the petitioner, namely, Rose Ali, who was arrested in connection with Chandmari P.S. Case No. 20/2025, shall be released on bail of ₹20,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (M), Guwahati, Assam.
12. It is hereby directed that the petitioner shall produce the documents to show that he has already paid some amount of money subsequent to passing of the instant order of this Court, then only his bail prayer shall be accepted by the court below.
