PEDA KOMIRA VILLAGE OF GAMPLAGUDEM MANDAL ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 3rd Respondent Police in not registering the Crime against the unofficial respondents No. 4 to 10 basing on the complaint of the petitioners dated 18.04.2018 in connection to criminal trespass in the petitioners property in S.No. 224/1A measuring an extent of Ac.1-00 Gts., situated Gampalagudem village, Krishna District and causing mischief by fire with intent to destroy the hayrick and cause damages to the petitioner and beet with intent to murder the petitioners, in spite of my complainant is illegal and void and opposed to Article 14, 19,21 and 300-A of Constitution of India and consequently to direct the 3rd respondent Police registering crime against the respondent No. 4 to 10 and to pass IA NO: 1 OF 2019 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased To direct the Respondents Police particularly 3rd Respondent Police to register the FIR basing on the Complaint dated 18-04-2018 to take action against the Respondent_. CHAKRAVARTHI WRIT PETITION NO: 4407 of 2019 The Court made the following Order: Heard learned counsel for the petitioner through Video Conference and learned Additional Government Pleader representing the State. 2. Learned Additional Government Pleader on written instructions would submit that basing on the petitioners’ report dated 18.04.2018, the Police registered a case vide Crime No.101 of 2018 on the file of Gampalagudem Police Station, for the offence under Sections 341, 323, 506 read with 149 IPC. After due investigation, a charge sheet vide C.C.No.1202 of 2018 was filed before the learned Judicial First Class Magistrate, Tiruvuru on 29.06.2018. Subsequently, the matter was settled before the Lok Adalat on 14.07.2018 itself. 3. In the light of the submissions made by learned Additional Government Pleader representing the State, this Court is of the opinion that the cause in the present Writ Petition does not survive for further adjudication. 4 4. Accordingly, this Writ Petition is closed at the stage of admission itself, without going into the merits of the case. No costs.
