Ms. Chhavi Sharma, AAG, Haryana. **** SANDEEP MOUDGIL, J (ORAL) This criminal writ petition has been filed under Article 226 of the Constitution of India for the issuance of a writ in the nature of Habeas Corpus for releasing the detenue from the illegal custody of the respondent No.4 and to direct the respondents No.1 to 3 to protect the life and liberty of the petitioner as well as the detenue. In compliance with the directions of this Court, the alleged detenue, namely Sumitra, has been produced before the Court by ASI Kanta Gill, No.175, Police Station Bhuna. Upon being questioned by the Court, the detenue disclosed that she had voluntarily left her parental home. After being duly counseled by the Anuradha 2025.08.23 00:56 I agree to specified portions of this document CRWP-8616-2025 (O&M) 2 Court, she has expressed her desire to accompany her father (the petitioner), who is present in Court today. The statements of alleged detenue and her father has been recorded in the Court which are taken on record and have been produced herein below also :- ‘STATEMENT OF SUMITRA, AGED ABOUT 23 YEARS, D/O SH. RAM NIWAS, R/O MOCHIWALI CHAUBARA (61), CHAUBARA, FATEHABAD, HARYANA. ON S.A. I voluntarily want to go with my father namely Mr. Ram Niwas (father) who is present in Court. The afore-said statement of mine is without any fear, coercion or undue influence.’ STATEMENT OF RAM NIWAS, R/O MOCHIWALI CHAUBARA (61), CHAUBARA, FATEHABAD, HARYANA. ON S.A. I hereby want to submit that I will take care of my daughter and retain her with love and affection.’ In view of the above, learned counsel for the petitioner prays for withdrawal of the present petition as nothing survives in the present petition.
