He was transferred from GIC, Lalkuan, Nainital to GIC, Joshyura, Block Okhalkanda in the same district, vide order dated 26.6.2023, passed by Additional Director, Secondary Education, Dehradun. Petitioner has challenged the said order of transfer on the ground that he is a kidney patient and he has to get regular follow-up treatment at higher medical centre. (3) Learned State Counsel, however, submits that petitioner was transferred after having rendered service at sugam places for more than 17 years. He submits that every government servant is liable to be transferred to a durgam place after serving for certain length of period at sugam places. Thus he submits that there is no infirmity in the order of transfer passed in respect of petitioner. (4) This Court finds substance in the submission made by learned State Counsel. Since petitioner holds a transferable post and he has been transferred as per the provisions of Transfer Act, therefore, there is no scope for interference. Writ petition is, however, disposed of with liberty to petitioner to make a representation to the competent authority highlighting his medical condition. If petitioner makes such representation within two weeks, decision 2025:UHC:9256 thereupon shall be taken by the competent authority within six weeks thereafter.
