The Petitioner is before this Court seeking for the followingw reliefs: a. Issue a writ, order or direction in the nature of mandamus to the respondent 1 to take a decision on the recommendation made by the state Government for premature release of the convict prisoner No.3926 Sri. Sampangappa S/o Munivenkatappa expediously. b. Issue a writ, order or direction in the nature of mandamus to the respondent No.4 to release the convict prisoner No. 3926 Sri. Sampangappa S/o Munivenkatappa on parole till the decision of the - 3 - HC-KAR NC: 2025:KHC:43230 WP No. 27170 of 2025 Government on premature release in the interest of justice. c. Pass any other order/directions considering the facts and circumstances of the case together as to costs in the terms of justice. 2. Learned AGA on instructions submits that the Advisory Board and the Life Convicts Release Committee (LCRC) having recommended the premature release of the petiitoner. The matter is now pending before Central Government for approval. 3. Sri H.Mallanagoud, learned counsel for respondent No.1-Central Government submits that the said recommendation would be considered, and necessary orders passed within 45 days from today. 4. Since the recommendation has already been made by the Advisory Board and the LCRC, I am of the considered opinion that the Petitioner can be released on parole till the orders are passed by the Central Government. - 4 - HC-KAR NC: 2025:KHC:43230 WP No. 27170 of 2025 5. In that view of the matter, I pass the following: ORDER i. Writ petition is allowed. ii. Respondent No.1 is directed to release the Petitioner on general parole till the orders are passed by Respondent No. 1 by imposing usual conditions.
