HIGH COURT OF JUDICATURE AT ALLAHABAD CONTEMPT APPLICATION (CIVIL) No. - 4484 of 2025 Court No. - 7 HON'BLE PIYUSH AGRAWAL, J. Heard learned counsel for the applicant and learned standing counsel for the opposite party. This contempt application has been filed for punishing the opposite party for willful disobedience of the order dated 4.3.2025 passed by this Court in Civil Misc. Writ Petition No. 19160 of 2024. wherein this Court has observed as under: "4. In the given facts and circumstances, while I decline to grant indulgence in the matter of order of suspension, I hereby provide that since the petitioner has already submitted reply to the chargesheet the departmental enquiry shall be concluded within a maximum period of two months of production of certified copy of this order and the petitioner shall be cooperating with the same. After the enquiry report is submitted as the case may be the departmental enquiry and the disciplinary proceedings shall be concluded within the next one months' time. 5. It is made clear that the claim for salary shall abide by the result of the disciplinary proceedings. It is further provided that in the event despite due cooperation rendered by the petitioner the departmental enquiry and disciplinary proceedings is not concluded as directed hereinabove the order of suspension passed against the petitioner pursuant to the order dated 23.03.2023 shall stand revoked. " It is stated that in spite of service upon the opposite party no order has yet been passed. Prima facie, a case of contempt has been made out. However, considering Versus Counsel for Applicant(s) : Manish Kumar Kashyap, V.P. Singh Kashyap Counsel for Opposite Party(s) : Dr. Hakim Singh .....Applicant(s) Dr. Ratan Pal Singh Suman, Director General Medical And Health Services .....Opposite Party(s) the facts and circumstances of the case, one more opportunity is afforded to the opposite party to comply with the aforesaid order of this Court within three months from the date of production of a copy of this order. The applicant shall supply a duly stamped registered envelope addressed to the opposite party and another self-addressed stamped envelope to the office within one week from today. The office shall send a copy of this order along with the self-addressed envelope of the applicant with a copy of contempt application to the opposite party within one week thereafter and keep a recorded thereof. The opposite party shall comply with the directions of the writ court and intimate him of the order through the self-addressed envelop within a week thereafter. With the aforesaid observations, this application is disposed. In case the order is not complied with by the opposite party within the aforesaid period, the applicant shall be at liberty to approach this Court again.
