THE FILE OF THE HONBLE VI ADDL. CITY CIVIL AND SESSIONS JUDGE AT BENGALURU CITY, CCH 11 AS PER ANNX-A.
THIS PETITION, COMING ON FOR ORDERS, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE M.NAGAPRASANNA
ORAL ORDER
This Court, on 31.07.2025, had passed the following
order:
"The petitioner is before this court calling in question the proceedings in Execution Petition No.999/2025. The Coordinate Bench of this Court in terms of its order dated 25.04.2025 had granted an interim order of stay of further proceedings at the Executing Court. The learned counsel for the respondent has filed his application seeking vacation of the interim order. The counsel for the parties would submit that the order granting injunction in favour of the respondent was challenged before the First Appellate Court and the First Appellate Court has 7 days ago affirmed the said order. The learned counsel for the petitioner submits that the meeting of the Management Committee on the said issue is today and therefore, seeks two weeks time to either withdraw this petition or place on record the decision that will be taken by the Managing Committee. In the light of the interim order subsisting and the aforesaid circumstance, finally list this matter on 20.08.2025. In the event nothing is placed before this court, the interim order will have to get vacated.
