2. The petitioner is in judicial custody in connection with Baisi P.S. Case No. 82 of 2020 instituted under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act lodged on 05.04.2020 by the informant, Rajaram Prasad.
3. As per the prosecution story, the informant alleged that during evening patrolling, upon information, a white colour pickup van was intercepted and 333 liters of foreign liquor recovered/seized. Accordingly, the FIR.
4. Learned counsel for the petitioner submits that he owns the vehicle but had no knowledge about the criminal activity of his driver and is in custody since 12.11.2024.
5. Learned APP on the other hand has drawn the
Patna High Court CR. MISC. No.780 of 2025(2) dt.05-03-2025 2/2 attention of this Court to the paragraph-3 to show that he has criminal antecedents of the same nature and further, the FIR was lodged in the year 2020 but he evaded arrest for four years.
6. Taking into account the aforesaid facts as also that the petitioner has criminal antecedent, for the present, this Court is not inclined to grant him relief.
7. The present bail application stands rejected.
