No.123/26 with an total extent of 2622 Sq. ft at Kovilambakkam village, Sholinganallur Taluk,Chengalpet District on the basis of representation sent by petitioner dated 17.2.2025 For Petitioner(s): Mr.D.Rajagopal For Respondent(s): Mr.C.Prabakaran, Government Counsel for R1 and R4 Order This Writ Petition has been filed seeking a direction to the respondents to pay compensation for the acquisition of the petitioners’ land and building, based on the petitioners' representation dated 17.02.2025. 2. The learned counsel appearing for the petitioners submitted that the petitioners are the absolute owners of the property measuring a total extent of 2,622 sq. ft., comprised in Old S.F. No. 123/1B Part, New S.F. No. 123/26, situated at Kovilambakkam Village, Sholinganallur Taluk, Chengalpattu District, and they are in peaceful possession and enjoyment of the same. They have constructed a dwelling house thereon and have let out a portion of it for rent. He further submitted that the respondent Chennai Metro Rail Limited (CMRL) has decided to acquire their property without initiating formal land acquisition proceedings and without issuing any statutory notice. He contended that the respondent straightaway attempted to take possession of the petitioners’ property without following the mandatory requirements of the relevant land acquisition laws. 4. Consequently, on 17.02.2025, the petitioners sent a formal representation requesting the respondents to follow the due process of law as contemplated under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, and to determine and disburse fair compensation to the petitioners for both the land and the building structure. Since the said representation has not been considered till date, the petitioners have approached this Court. 5. The learned Government Counsel appearing for the respondents 1 to 4 would submit that the petitioner’s representation dated 17.02.2025 will be disposed of by the 4th respondent within a period of six weeks. 6. In view of the above, this Court directs the 3rd respondent to consider the petitioner’s representation dated 17.02.2025 on its own merits and dispose of the same in accordance with law within a period of six weeks from the date of receipt of copy of this order, after issuing notice and shall afford the petitioners with an opportunity of personal hearing. 8. With the above directions, this writ petition is disposed of. No costs.
