Order No. 03 Dated: 09.04.2025 The present writ petition has been filed for issuance of direction upon the concerned respondents to pay compensation to the petitioner for acquisition of his land appertaining to plot no. 392, Khata No. 95, Mouza- Tektha, P.O. & P.S.- Tandwa, District- Chatra measuring an area of 3.30 acres for construction of (Tori-Shivpur) New B.G. Railway Line as, according to him, even after completion of the land acquisition proceeding, neither due compensation amount has been paid nor other consequential benefits have been extended to him. 2. Learned counsel for the petitioner submits that the petitioner being the descendent of ‘Jamabandi Raiyat’ of the aforesaid land namely Jhakki Ganjhu was in possession of the same and had paid rent to the Government till 2021. 3. It is further submitted that the State Government acquired various lands including the aforesaid land for construction of (Tori- Shivpur) New B.G. Railway Line and accordingly L.A. Case No. 02/2017-18 was initiated with respect to the petitioner’s land. Subsequently, after verification of the record, a meeting under the 2025:JHHC:11034 2 Chairmanship of Additional Collector, Chatra (the respondent no. 3) was held on 22.06.2018 and it was decided to grant “Raiyati Manyata” with respect to the aforesaid land in favour of the petitioner. Despite the said fact, payment of compensation with respect to the aforesaid land has not been made to the petitioner. Though the petitioner represented the District Land Acquisition Officer, Chatra (the respondent no. 4) requesting inter alia to make payment of compensation amount to him, however the same remained unresponded. Under the said compelling circumstance, the petitioner has filed the present writ petition. 4. Mr. Mohan Kumar Dubey, learned A.C. to A.G. appearing on behalf of the respondents, submits that if the petitioner prefers a fresh representation on the present issue before the competent authority i.e., the respondent no. 4, an appropriate decision will be taken within a time frame. 5. Having heard learned counsel for the parties and considering the nature of prayer made in the writ petition, without entering into the merit of the case, the petitioner is given liberty to prefer a fresh representation on the present issue before the respondent no. 4. On receipt of the said representation, the respondent no. 4, after verifying the relevant records of the case and on providing an opportunity of hearing to the petitioner/his representative, shall take an appropriate informed decision within six weeks from the date of filing of the said representation. 6. The writ petition is accordingly disposed of with the aforesaid liberty and direction. Ritesh/ (Rajesh Shankar, J.)
