HIGH COURT OF JUDICATURE AT ALLAHABAD MATTERS UNDER ARTICLE 227 No. - 10499 of 2025 Court No. - 85 HON'BLE VINOD DIWAKAR, J.
1. The present petition has been filed seeking a direction for the expeditious disposal of the appeal preferred by the husband against the order dated 18.10.2023 before the learned Additional District & Sessions Judge, Ghaziabad.
2. Upon perusal of the record, it transpires that the said appeal is pending before the appellate court and, despite the matter having been listed and heard on as many as twenty occasions, no effective order has been passed till date. Such delay not only frustrates the very object of maintenance proceedings but also defeats the underlying purpose of providing immediate relief and sustenance to the claimant.
3. In the circumstances, the learned Additional District & Sessions Judge, Ghaziabad is directed to decide the pending appeal strictly in accordance with law, expeditiously and preferably within a period of three months from today. In the meantime, the appellate court shall ensure that the wife is not deprived of her lawful entitlement to maintenance, and, if no interim arrangement is already in place, the same shall be made without delay. It is further directed that no unnecessary adjournments shall be granted to either party.
4. With the aforesaid observations and directions, the present petition stands disposed of. September 4, 2025 Anil K.
