2. The learned counsel for the petitioner submitted that the 2nd petitioner had purchased two vacant house sites, bearing Plot Nos. 27 and 28A, in "Sundar Nagar," situated at No. 82, Varadharajapuram Village, comprised in S.F. Nos. 306/4 and 306/3B7, Kundrathur Taluk, Kancheepuram District, by virtue of a Sale Deed dated 20.11.1980. Subsequently, by way of a Settlement Deed dated https://www.mhc.tn.gov.in/judis
WP No. 20907 of 2025 __________ Page3 of 6 16.03.2021, the 2nd petitioner settled the aforementioned property in favour of her mother and the 1st petitioner, which was duly registered.
3. When the 1st petitioner approached the Member Secretary seeking the issuance of a No Objection Certificate (NOC) to construct a house on the subject property, there was no proper response. Consequently, the petitioners obtained information under the Right to Information Act, 2005, which revealed that the subject land had been acquired by the Government of Tamil Nadu for the execution of the Outer Ring Road Project way back in the year 2003, and an award had also been passed.
4. It is contended by the petitioners that no notice under the relevant Land Acquisition Act was ever served upon the 2nd petitioner. Therefore, the petitioners sent a representation to the respondents on 25.02.2025, requesting them either to reconvey the land or to pay compensation at the prevailing market rate. Although the 3rd respondent, by his proceedings dated 18.03.2025,
directed the 6th respondent to take appropriate action on the petitioners’ representation, no orders have been passed till date. Aggrieved by the inaction, the petitioners have approached this Court.
5. Learned Government Counsel appearing for the respondents would submit that the petitioner’s representation dated 18.03.2025 will be disposed of by the respondents within a period of six weeks. https://www.mhc.tn.gov.in/judis
