The case of the petitioner is that the property comprised in S.F. No. 60/5A1, measuring an extent of 0.30.5 hectares, situated at Utthamasolapuram Village, Salem South Taluk, Salem District, originally belonged to his father. By way of succession, the petitioner is in possession and enjoyment of the property, and the patta also stands in his name. 3. While so, during the year 2007, for the purpose of extending the highway, 93 sq. meters of land in the aforementioned survey number was acquired by the 2nd respondent under the National Highways Act, 1956, and an award was subsequently passed on 20.12.2007. The 3rd respondent also sent a communication directing the petitioner to receive the compensation and hand over possession of the acquired land. However, the petitioner was not in a position to appear before the 3rd respondent at that time, although the 93 sq. https://www.mhc.tn.gov.in/judis WP No. 9948 of 2025 __________ Page3 of 5 meters of land had already been taken over by the respondents for the highway extension project. 4. Thereafter, the petitioner approached the 3rd respondent on several occasions seeking the release of the compensation, and ultimately submitted a formal representation before the respondents on 03.12.2024. Since the said representation has not yet been considered, the petitioner has approached this Court. 5. The learned Government Counsel who takes notice on behalf of the respondents would submit that the petitioner’s representation dated 03.12.2024 will be disposed of by the respondents within a period of eight weeks. 6. Heard the learned counsel for the petitioner and the learned Government Counsel for the respondents and also perused the materials available on record. 7. In view of the above, this Court directs the respondents 1 to 4 to consider the petitioner’s representation dated 03.12.2024 on its own merits and dispose of the same in accordance with law within a period of eight weeks from the date of receipt of copy of this order, after issuing notice and an opportunity of personal hearing to the petitioner. https://www.mhc.tn.gov.in/judis WP No. 9948 of 2025 __________ Page4 of 5 8.
