Vide order dated 5th September, 2024, this Court by way of an interim order, directed the petitioner to deposit a sum of Rs. 40.00 lacs in the account of the respondent bank and, subject thereto, directed the respondents not to initiate any coercive action against the petitioner. That
order was not complied with by the petitioner, despite availing several opportunities for the purpose.
On the last date of hearing i.e., 5th May, 2025, the interim order was vacated and the respondent bank was left free to proceed against the petitioner to recover the amount in accordance with law.
Today, neither the petitioner nor his counsel has turned up to appear in the matter. It seems that the petitioner, having failed to comply with the order of the Court, has decided not to appear in the matter.
Be that as it may, since nobody has appeared on behalf of the petitioner, the petition is dismissed for want of prosecution. The respondent bank shall be at liberty to recover the amount due in accordance with law.
