Serial No.7 REGULAR CAUSE LIST IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR CCP(S) 414/2022 In[WP(C) 1778/2020] Haji Ali Mohammad Lone …Petitioner(s) Through: Mr. Firdous Ahmad Bhat, Advocate Vs. Niteshwar Kumar and Others ...Respondent(s) Through: Mr. Mohd Younis Hafiz, Assisting Counsel vice Mr. Abdul Rashid Malik, Sr. AAG CORAM: HON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE ORDER 25.08.2025 1. If not letter wise but spirit wise compliance of direction given in the writ court order dated 21.12.2021 thereby directing payment of Rs. 5,14,000/- along with interest @ 6% per annum from the date of said amount of Rs. 5,14,000/- becoming payable to the petitioner, has been carried out during the pendency of this contempt petition and on that count the petitioner is not pursuing any grievance in that respect. 2. However, the petitioner is insisting that in writ court order dated 21.12.2021, timeline for the writ respondents to make payment of Rs. 5, 14,000/- along with interest @ 6% per annum was two months from the date of delivery of the copy of the judgment failing which payment was supposed to take place @ 9% per annum. 3. Said time line was given to the writ respondents to serve as a recurring reminder that payment of Rs. 5,14,000/- along with interest @ 6% per annum in favour of the petitioner was to be carried out with due dispatch. 4. This contempt petition was instituted by the petitioner on 15.09.2022 while he himself wasted time from the expiry of two months’ period. 5. Be that as it may, the fact that the petitioner has been paid the principal amount along with interest @ 6% per annum thereupon is fair and sufficient enough to hold that compliance of the writ court direction has been carried out and there is no willful disobedience and deliberate non-compliance at the end of the contemnors/ respondents, as such, this contempt petition is closed as disposed of.
