Heard the parties.
The petitioner has been made accused in connection with Ramna P.S. Case No. 163 of 2024, for the offence registered under Sections 103(1), 238 & 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of Sri S. K. Napit, learned Judicial Magistrate, 1st class, Nagar Untari, Garhwa.
On 06.12.2024 at about 10:00 p.m., the husband of the informant namely Ejajat Ali went missing. On 07.12.2024, his dead body was recovered from a well.
Suspicion has been raised upon the petitioner and co-accused persons that due to previous enmity, they might have committed his murder.
Learned counsel for the informant has vehemently opposed the prayer for bail and submitted that prior to the occurrence, petitioner and co-accused persons had threatened the deceased.
Considering the nature of allegation, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri S. K. Napit, learned Judicial Magistrate, 1st class, Nagar Untari, Garhwa, or his successor, in connection with Ramna P.S. Case No. 163 of 2024.
