Heard Mr. P. Sundi, learned counsel for the applicants. Also heard Mr. R. Sharma, learned counsel for the opposite party.
2. This interlocutory application is preferred by the applicants for allowing them to withdraw 50% of the awarded amount deposited by the opposite party before the Registry of this Court.
3. Mr. Sundi, learned counsel for the applicants submits that pursuant to the
order dated 24.07.2019, in I.A. (Civil) No. 2396/2019, the opposite party has deposited 50% of the awarded amount before the Registry of this Court, and that the applicants may be allowed to withdraw the same.
4. On other hand, Mr. Sharma, learned counsel for the opposite party submits that he may be granted some time to file objection in this application.
5. However, Mr. Sundi, learned counsel for the applicant has pointed out that the learned Tribunal had ordered for pay and recovery and that there is no question of raising any objection by the opposite party. Mr. Sundi also submits that the applicants are ready to furnish a bond in this regard.
6. Taking note of the submissions of learned counsel for both the parties, and also considering the facts and circumstances on the record, this Court is inclined to allow this interlocutory application.
7. Accordingly, the applicants are allowed to withdraw 50% of the awarded amount deposited before the Registry of this Court on furnishing an indemnity bond of equal amount.
