Heard the counsel for the petitioner and the A.G.A. for the State. The present petition has been filed for the following relief:- "i) Issue a writ, order or direction in the nature of Certiorari for quashing the impugned F.I.R. dated 06.07.2023 registered as Case Crime No. 4343 of 2023, under section - 135 Electricity Act, Police Station Anti Power Theft Kila, District - Bareilly. ii) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents to not to arrest the petitioner in Case Crime No. 4343 of 2023, under section - 135 Electricity Act, Police Station Anti Power Theft Kila, District - Bareilly" The recital in the first information report discloses commission of the offence. In view of the aforesaid, no case for quashing the first information report is made out. However, considering the fact that the offence is compoundable, we direct that the petitioner shall not be arrested during the course of investigation. With the aforesaid observations the petition is disposed of.
