PUBLIC PROSECUTOR The Court made the following Order: The petitioners are arraigned as Accused Nos.1 to 5 in Crime No.289 of 2024 of Phirangipuram Police Station, Guntur District. The petitioners are alleged to have committed offences under Sections 115(2), 351(2), 79 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘BNS’). 2. The learned counsel for the petitioners submits that the complaint was filed in view of the political rivalry in the village and that the petitioners are falsely implicated by the de facto complainant. It is also submitted that the petitioner No.2 gave a 2 report to the police on 25.12.2024; however, the police registered the case on 31.12.2024 as FIR No.301 of 2024 against the respondent No. 2 and three other family members. 3. The learned counsel for the petitioners further submits that the petitioners also filed a complaint on the same day of the alleged incident, i.e., 25.12.2024. However, the police registered the case filed by the respondent No.2 on 26.12.2024 and registered the case filed by the petitioner No.2 on 31.12.2024. 4. Considering the rival complaints, this Court deems it appropriate to dispose off the criminal petition by directing the Station House Officer/Investigating Officer, Phirangipuram Police Station, Guntur, to follow the procedure as contemplated under Section 35(3) of the Bhartiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’).
