Present petition has been preferred with the prayer to issue appropriate order or direction commanding the learned Chief Judicial Magistrate, District Jalaun at Orai to dispose of the Complaint Case no. 5761 of 2023 (Jag Prasad Chaturvedi vs. Shashank Dwivedi) within some determined time, pending for disposal since 20.07.2023. 3. It is submitted by learned counsel for petitioner that although in the aforesaid case no. 5761 of 2023 summoning order has already been issued but the same is pending before learned concerned court only at the behest of non-appearance of respondent no. 2. 4. Per contra, learned AGA vehemently opposed the prayer sought through the instant petition but could not dispute the aforesaid facts. 5. Be that as it may, learned Chief Judicial Magistrate, District Jalaun at Orai/ court concerned is hereby directed to ensure appearance of respondent no. 2 within two months from the date of production of certified copy of this order and thereafter further proceed with the complaint case no. 5761 of 2023 (Jag Prasad Chaturvedi vs. Shashank Dwivedi) . 6. The instant petition stands disposed of accordingly.
