10/07.02.2025 The present contempt application has been filed against the opposite parties alleging wilful disobedience and non-compliance of the order dated 21.12.2022 passed by this Court in W.P.(C) No. 5257/2022.

Ms. Sweety Topno, leaned counsel for the O.P.No.3, while referring to paragraph 8 of the show cause affidavit dated 28.02.2024, submits that the National Highway Authority of India being aggrieved with the amended award has preferred an application under Section 34 of the Arbitration and Reconciliation Act, 1996 being Arbitration Case No. 05/2023 in the Court of the Civil Judge (Sr. Div.-I), Bokaro and the same has been admitted for consideration.
3. Having heard leaned counsel for the parties and considering the aforesaid submission made by learned counsel for the O.P.No.3 as well as keeping in view the observation made in paragraph 4 of the order dated 21.12.2022 passed in W.P.(C) No. 5257/2022, this Court is of the view that no case of contempt is made out against the opposite parties at this stage.
4. The present contempt application is accordingly dismissed.
5. The concerned parties are however at liberty to pursue their respective cases in the aforesaid arbitration case.
