JUSTICE RAJNESH OSWAL, JUDGE O R D E R 09-09-2025 Learned counsel for the petitioners submits that the petitioners are bona-fide residents of Union Territory of Jammu and Kashmir and trained/licensed in water ski and water sports by Ministry of Tourism. He submits that the Tourism Department had advertised water sports (including jet ski) to attract tourists and create employment opportunities. And relying on such Schemes, the petitioners purchased Jet Skiing for livelihood. And incurred a huge cost. Accordingly, they applied to the Chief Engineer, Irrigation and Flood Control, Srinagar, for permission to operate Jet Ski and other allied water sports at Dal Lake. Particularly as similarly situated persons had already been granted such permissions pursuant to certain orders passed by this Court from time to time. It is submitted that even though the application seeking permission was moved by the petitioners over a year ago followed by repeated representations but no avail. Thus, this petition. Served with advance copy of the petition Mr. Mohsin Qadiri, learned Senior AAG is present in Court on behalf of the respondent. At the outset, he submits that in the event any such application, as indicated above, is pending consideration, the same shall be taken cognizance by the competent authority and necessary orders in accordance with law shall be passed. However, he submits that considerable time has already elapsed, the authority be directed to pass necessary orders within a specific time. To this learned senior counsel for the respondents submits that appropriate orders in accordance with law shall be passed as expeditiously as possible preferably within a period of two months.
