Net amount of Rs.14,53,040/- Suc duty of Rs.25,000/- D.No.43992/25 dated 18.11.2025 For Petitioner(s): M/s.M.Udayakumar https://www.mhc.tn.gov.in/judis OP No. 620 of 2025 __________ Page2 of 7 ORDER This Original Petition has been filed under Section 372 of the Indian Succession Act, 1925, read with Order XXV Rule 6 of the Original Side Rules, seeking a succession certificate in respect of 1,640 equity shares standing jointly in the names of the petitioners’ parents, Panna Devi Chordia and M. Sardarmal Chordia. 2. Panna Devi Chordia died intestate on 25.05.2021. Her husband, M. Sardarmal Chordia, survived her and thereafter died intestate on 09.06.2021. The petitioners are their son and two daughters. The legal-heir certificates issued in respect of both deceased persons identify the petitioners as their surviving legal heirs. 3. The securities covered by the petition are 1,640 fully paid-up equity shares of the company formerly known as Strides Shasun Limited, now Strides Pharma Science Limited, under Folio No. SAL102585 and Share Certificate No. 100585, bearing distinctive numbers 59756989 to 59758628, both inclusive. The shares stood jointly in the names of Panna Devi Chordia and M. Sardarmal Chordia. Their value, as stated in the schedule to the petition, is Rs.14,53,040/-. 4. The first petitioner was examined as P.W.1. He reiterated the averments in the petition. Exs.P1 to P8 were marked, comprising the death certificates of both deceased persons, their legal-heir certificates, the share certificate, the communication issued by KFin Technologies Limited, the paper publication and the certificate relating to the electronic records. The share certificate and the communication of KFin Technologies Limited were compared with their originals while marking them. https://www.mhc.tn.gov.in/judis OP No. 620 of 2025 __________ Page3 of 7 5. The communication dated 29.07.2025 issued by KFin Technologies Limited records that the original share certificate for 1,640 shares had been submitted for transmission and requires production of a succession certificate, letters of administration or probate for processing the request. 6. General notice was published in the Tamil daily Makkal Kural on 14.02.2026. No objection was received pursuant to the publication. The learned Master has recorded completion of service and the absence of objections. The requisite succession duty has also been paid. 7. Since the shares were jointly held, upon Panna Devi Chordia’s death, the surviving joint holder, M. Sardarmal Chordia, transmitted the shares in his name. Upon his subsequent death, the beneficial interest in the securities devolved upon his legal heirs. In the present case, the petitioners are admittedly the children and surviving legal heirs of both joint holders. Thus, no competing claim arises on account of the sequence of deaths. 8. The death of both holders, the petitioners’ relationship with them, the existence of the securities and the requirement of a succession certificate have been established by the oral and documentary evidence. There is no material showing the existence of any Will, any rival claimant or any impediment under Section 370 of the Indian Succession Act. The petitioners have therefore established their prima facie entitlement under Section 373 of the Act. 9. Accordingly, this Original Petition is allowed. A succession certificate shall be issued jointly in favour of the three petitioners, in equal shares, in respect of the following securities: https://www.mhc.tn.gov.in/judis OP No. 620 of 2025 __________ Page4 of 7 1,640 fully paid-up equity shares of Strides Pharma Science Limited, formerly Strides Shasun Limited, under Folio No. SAL102585 and Share Certificate No.100585, bearing distinctive numbers 59756989 to 59758628, together with all dividends, bonus shares, split or consolidated shares, accretions and other benefits, if any, attached thereto. 10. The petitioners are authorised to receive, transmit, dematerialise, negotiate or otherwise deal with the aforesaid securities in accordance with law and the requirements of the company, its Registrar and Transfer Agent and the concerned depository participant and with power to collect the debts and to receive the interest and dividends on and negotiate and for terminal benefits, if any, specified in the Schedule, as applicable till the date of withdrawal, is issued.
