HON'BLE SRI JUSTICE K.SURESH REDDY CRIMINAL PETITION No. 2056 OF 2025 ORDER: As per the directions of My Lord the Hon'ble the Chief Justice, this criminal petition has been allotted to this Bench by notice dated 25-03-2025 and the same is treated as part of the roster effective from 26-03-2025. 2. This criminal petition, under Section 482 of Bharatiya Nagarik Suraksha Sanhita, is filed by the petitioner seeking to release him on bail in the event of arrest in crime No. 231 of 2024 of Chilakalapudi (U) Police Station, Krishna District, registered for the offences punishable under Sections 192, 196, 336 (4), 340 (2), 353 (2) and 111 (2) of Bharatiya Nyaya Sanhita and Section 67 of Information Technology Act. 3. Heard Sri P.M.Mithileswara Reddy, learned counsel appearing for the petitioner, and learned Additional Public Prosecutor appearing for the respondent-State. 4. Case of the prosecution is that de facto complainant is working as President of Machilipatnam Telugu Desam Party Assembly Constituency since 2021. It is alleged that one Bodi 2 Venkatesh and Bottipati Pavan Kumar have posted objectionable messages along with morphed photographs in facebook in the name of Jagananna Synyam. They used abusive language in the said social media platform. They also circulated fake messages against the persons belonging to Telugu Desam Party and Janasena. They also posted messages in social media against the Government. On the basis of the said allegations, the present crime has been registered. 5. Learned Additional Public Prosecutor vehemently opposed the criminal petition on the ground that on the basis of confession made by accused No. 1, the name of the petitioner has been included in the present crime. 6. This Court has perused the report given by de facto complainant. The entire allegations are made only against accused Nos. 1 and 2 and nothing has been attributed to the present petitioner. A reading of the FIR would disclose that the name of the petitioner has not been stated by de facto complainant anywhere. 3 7. In view of the above facts and circumstances, as there is no reference to the name of the petitioner in the FIR, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. 8. The petitioner is, therefore, directed to surrender before the Station House Officer, Chilakalapudi (U) Police Station, Krishna District, on or before 17-04-2025. On such surrender, the petitioner is ordered to be enlarged on bail on his executing a personal bond for Rs.10,000/- with two sureties for the like sum each to the satisfaction of the Station House Officer, Chilakalapudi (U) Police Station. After release, the petitioner is directed to report before the Station House Officer, Chilakalapudi (U) Police Station, once in a week i.e. on every Monday between 10 a.m. and 1 p.m. until further orders. 9.
