JUSTICE LALITHA KANNEGANTI Digitally signed by MEGHA MOHAN Location: HIGH COURT OF KARNATAKA - 2 - HC-KAR NC: 2025:KHC:28708 RPFC No. 15 of 2022 ORAL ORDER Aggrieved by the order passed in Crl.Misc.No.422/2018 dated 10.11.2021, whereby the Court had enhanced the maintenance amount from Rs.3,000/- to Rs.4,000/- per month, the wife is before this Court seeking enhancement of the maintenance. 2. The parties are referred to as the husband and wife for the sake of convenience. 7 3. Earlier, the wife had filed a petition i.e. Crl.Misc.No.326/1995 seeking maintenance wherein the maintenance of Rs.300/- per month was awarded and again in the year 2000, she had filed a petition seeking enhancement and it is enhanced from Rs.300/- to Rs.1,500/- per month. Again in the year 2012, she had filed another petition in Crl.Misc.No.316/2012 seeking enhancement of the maintenance, wherein the maintenance was enhanced from Rs.1,500/- to Rs.3,000/- per month, as per order dated 21.08.2013. Again an application was filed seeking enhancement of maintenance from Rs.3,000/- per month to Rs.15,000/- per month. The Court, by the order impugned, had enhanced the maintenance to Rs.4,000/- per month and - 3 - HC-KAR NC: 2025:KHC:28708 RPFC No. 15 of 2022 while passing the said order, the Court had observed that considering the landed property of the husband, the Court has enhanced an amount of Rs.1,000/-. 4. Learned Counsel for the petitioner submits that the husband is having the landed property. Either before the Court below or before this Court, there is any evidence to show what is the income the husband is deriving from the landed property. The land which is in the name of the father to an extend of 8 acres, is already given to the children. The petitioner/husband, as on today is aged about 71 years. 5. Considering all these aspects, this Court do not find any reasons to enhance the maintenance amount. 6. Accordingly, the petition is dismissed. 7. All IAs., in this petition shall stand closed.
