ORDER:
The present Writ Petition is filed seeking for the following relief:
“to declare the action of the respondents in not refunding the deposited amounts as deposited at the time of contract as security to undertake the works even completing the observation period amounting to Rs 24,62,149/ to the petitioner with interest till the date of refund from the date of completion of respective observation periods as illegal, arbitrary, violation of principles of natural justice and violative of Article 14, 19 (i) (g), 21 of the Constitution of India and consequently direct the respondents to release and repay the deposited amounts for the above works immediately with interest of 12 percentage”. 2. The case of the Petitioner is that he had taken up work of supply and delivery of furniture to Ward Secretariats in R(EE-1) in Kakinada Municipal Corporation and at other places i.e.,Tuni Municipality and Rajahmundry Municipal Corporation. Though the supplies were made and work was executed, the final bill is yet to be paid. Apart from that the deposits made towards EMD 2.50%, FSD 2.5% and 5% GST were not paid. The total

amount claimed to be due towards EMD and FSD for all the works executed by the Petitioner is Rs.24,62,149/-. Hence, as the amounts were not paid, the present Writ Petition is filed. 3. The Standing Counsel submitted that he does not have ready instructions. 4. Considering the nature of claim, it would be appropriate to dispose of the Writ Petition with following directions: i) The Respondent authority shall examine the claim of the Petitioner within a period of Eight (08) weeks; and ii) On satisfaction of the execution of works and the quality of supplies made by the Petitioner, amounts found to be due to the Petitioner shall be paid within a further period of Eight (08) weeks. 5.
With the above observation, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, pending applications, if any, shall stand closed. _________________ NYAPATHY VIJAY, J
