JUSTICE BISWAJIT PALIT Order 10/07/2025 Heard Mr. Debasish Datta, learned counsel appears for the petitioners and Mr. Bidyut Majumder, learned Deputy S.G.I. appears for the respondent No.1-Union of India. The instant writ petition has been preferred by the petitioners claiming to be public-spirited citizens of South Tripura District with the following prayers: “Under the afore stated premises, it is humbly prayed that Your Lordships may be graciously pleased to admit this PIL Petition, call for the records and issue Rule calling upon the Respondent Authorities to show cause as to why, a Writ in the nature of Mandamus and/or Certiorari and/ or any other Writ, direction or Order of the like nature be not issued directing the Respondent Authorities to cancel the allotment of Retail Outlet at Hrishyamukh, Belonia, Tripura (S) in favour of Respondent No. 5 in the interest of the public at large after declaring the same to be illegal and against the interest of the public of that area and after hearing the parties, be further pleased to make the Rule absolute and/ or pass such further or other Order (s) as Your Lordships may deem fit and proper. -AND- Pending disposal of the instant PIL petition, Your Lordships may be further pleased to stay all further works undertaken by Respondent No.5 towards establishment of the Retail Outlet at Hrishyamukh, Belonia, South Tripura on the strength of the allotment order issued by Respondent No. 4. AND For this act of kindness, the Petitioners, as in duty bound, shall ever pray.” The writ petition, however, lacks necessary material details. Therefore, Mr. Debasish Datta, learned counsel for the petitioner, seeks to withdraw the instant writ petition with liberty to file a fresh petition. Accordingly, as prayed for, the instant petition is dismissed as withdrawn with the aforesaid liberty. Pending application(s), if any, shall stand disposed of.
