Present applicant Buta Singh, S/o Late Dalip Singh is praying for regular bail in relation to FIR dated 06.04.2025, registered as FIR No. 77 of 2025 at P.S. Nanakmatta, District Udham Singh Nagar wherein the present applicant has been implicated for the offences punishable under Section 8/21 of the NDPS Act. 4. It is submitted by the learned counsel for the applicant that applicant is innocent and has been falsely implicated and the alleged contraband which is shown to be recovered from the applicant is non commercial quantity. He further submits that there is no substantial compliance of Section 42, 50 and 55 of the NDPS Act. 5. On the other side, Mr. V.S. Pal, learned A.G.A. for the State on the basis of the written instructions apprise this Court that the applicant is a habitual offender and as many as there are seven cases against him out of which three cases relating to the NDPS Act. 6. After hearing the arguments of the learned counsel for the parties and further taking into consideration the long history of the applicant particularly cases relating to the NDPS Act this Court is of the view that that applicant does not deserve for bail. 7.
