JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 2 05-02-2025 Heard learned Counsel for the petitioner as well as learned APP for the State. 2. In this case, the petitioner is seeking regular bail in connection with Musrigharari P.S. Case No. 126 of 2024 registered for the offences punishable under Sections 25(1-B) (a), 25(1-AA), 26 and 35 of the Arms Act. 3. As per allegation, on secret information, the informant along with other police party reached the bathan of Attari Jha at Salempur and apprehended one person namely, Om Prakash Kumar Kapar @ Duliya. Upon search the bathan of Attari Jha, one loaded country-made pistol with two live bullets loaded in the magazine and a mobile were recovered under the bedding on the post in the bathan. He also told that he along Patna High Court CR. MISC. No.88780 of 2024(2) dt.05-02-2025 2/3 with his villagers Radh Jha @ Chintu Jha and Ranjit Kumar @ W Jha do illegal business of liquor. Before going to jail, both of them have given the recovered pistol to keep and in my presence, both of them have hidden other weapons/bullets in Raghav Jha's cattle shed which I can recover. For verification, the informant reached Raghav Jha alias Chintu Jha's cattle shed at 00.47 with the police force and following the search rules, on searching Raghav Jha alias Chintu Jha's cattle shed, a 9 mm country made automatic carbine and two live bullets in a magazine, three live bullets separately, four brass brushes for cleaning firearms kept in a plastic box were recovered from the pittu bag hidden under the gadra and sack. 4. Learned Counsel for the petitioner submits that the name of the petitioner has figured in the confessional statement of Om Prakash Kumar Kapar @ Dulia. The petitioner was not arrested at the spot and nothing was recovered from his possession. Except the confessional statement of co-accused, there is nothing against the petitioner. On the day of occurrence, the petitioner was in custody. In the present case, he is in custody since 24.09.2024. 5. On the other hand, the learned APP for the State opposed the prayer for bail. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Musrigharari P.S. Case No. 126 of 2024, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
