ORAL ORDER
Aggrieved by the
order passed in I.A.No.2 in Crl.Misc.No.760/2019 dated 18.01.2020 by the V Additional Principal Judge, Family Court, Bengaluru, whereby the Family Court had directed the petitioner/husband to pay ad-interim maintenance of an amount of Rs.10,000/- per month to the respondent No.1/wife and an amount of Rs.5,000/- each per month to respondent Nos.2 and 3/children and also directed to pay entire educational expenses of the children, the petitioner/husband is before this Court.
2. The parties are referred to as husband and wife for the sake of convenience.
3. Learned counsel for the husband submits that it is an ex-parte order. It is submitted that his income is an amount of Rs.20,000/- per month and paying maintenance of an amount of Rs.20,000/- per month to the wife and children and also

paying educational expenses is beyond the financial capacity of the husband. It is submitted that the order passed by the Family Court needs to be set aside and as per the interim order passed by this Court, he is already paying maintenance of an amount of Rs.10,000/- per month and he will continue to do so and there shall be a direction to the Family Court to dispose of the main petition itself.

Learned counsel appearing for the respondents submits that two months' amount is due and it is submitted that the Court had directed to pay the educational expenses also, so far, no amount is paid by the husband. It is submitted that it is the obligation and responsibility of the husband to take care of the wife and the children which he has failed to do.
5. Having heard the learned counsels on either side, perused the entire material on record. This is an ex-parte
order. There is nothing before the Court to show the income of the husband and the entitlement of the wife and the children. Considering the submissions of the learned counsel for the petitioner that the income of the husband is an amount of Rs.20,000/- per month, this Court deems it appropriate to

direct the husband to pay an amount of Rs.10,000/- per month pending disposal of the petition. Hence, this Court is passing the following order:
ORDER
i. The
order passed in I.A.No.2 in Crl.Misc.No.760/2019 dated 18.01.2020 by the V Additional Principal Judge, Family Court, Bengaluru, is modified. ii. The petitioner/husband is
directed to pay maintenance of an amount of Rs.10,000/- per month to the wife and children, pending disposal of the petition. iii. Crl.Misc.No.760 is of the year 2019, the Family Court shall dispose of the matter by 15.12.2025. iv. Accordingly, the writ petition is disposed of. v. All I.As. in this petition shall stand closed.
