This Civil Miscellaneous Petition is taken out to condone the delay of 49 days in filing the above Appeal Suit. 2.Heard the learned counsel for the petitioners. 3.Though the respondents have filed counter, none represents on behalf of the respondents. 4.The 1st petitioner would aver that, owing to the traffic accident, he sustained fracture in his leg, he was unable to make arrangements for filing the Appeal Suit. Consequently, a delay of 49 days has occurred in filing the Appeal Suit. 5. Accepting the averments made by the 1st petitioner in the affidavit enclosed with the petition, this Court is inclined to allow this Civil Miscellaneous Petition.
