1. This petition, seeking for interim bail, has been filed by the petitioner, on the ground that his wife is ill, and that she has been advised to undergo Laproscopic Chalecystectomy surgery by the doctor of Bangar Super Specialty Hospital, Zira Gate, Ferozepur City. 2. In nut-shell, the facts emerging from the record are that the petitioner is being prosecuted for the commission of offence punishable under Sections 22(C) of Narcotic Drugs and Psychotropic Substances Act, 1985, vide FIR No.13 dated 02.05.2025, Police Station State Special Operations Cell, Fazilka. The allegations against the petitioner are for being in conscious possession of 575 gram heroin. According to prosecution it was a chance recovery. 3. opportunity was afforded to the respondent-State. 4. Learned State Counsel has filed reply by way of affidavit of Assistant Inspector General of Police, SSOC, Fazilka, on behalf of respondent. The same be taken on record. 5. According to above mentioned reply this fact is true that wife of petitioner has been recommended for the above mentioned surgery. The copy of certificate issued by the doctor has also been placed on record and the same has also duly verified by the agency of the respondent-State. 6. Taking into consideration the above mentioned facts, it is hereby held that the petitioner is entitled for interim bail. However, in view of nature of surgery likely to be performed on the wife of petitioner it shall be appropriate that he be released on interim bail for a period of one week i.e. from 27.09.2025 to 03.10.2025. 9.
Accordingly, without commenting anything on the merits of the case, the present petition is hereby allowed and the petitioner is admitted to interim bail for a period of one week i.e. from 27.09.2025 till 03.10.2025, subject to his furnishing bail bonds to the satisfaction of learned trial Court. The petitioner shall surrender before the jail authority on 03.10.2025 at 5.00 P.M.
