PUBLIC PROSECUTOR The Court made the following: ORDER: This Criminal Petition, u/Sec.480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A1 and A2, seeking bail, in Crime No.202/2024 of Ramabhadrapuram police station, Vizianagaram District. 2. A case has been registered against the petitioners and others for the offence punishable u/Sec.8(c) r/w Sec.20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act. 3. Heard learned counsel for the petitioners and the learned Assistant Public Prosecutor representing the respondent/State. 4. Case of the prosecution, in brief, is that, on 12.12.2024 at 9.00 am, on receipt of credible information regarding illegal possession and transportation of ganja, the S.I of police, Ramabhadrapuram Police 2 Station along with his staff and mediators rushed to Kottakki Village junction and conducted vehicle checking. They noticed one lorry stopped at some distance and on seeing police, two inmates in the lorry tried to escape. Then police apprehended them. After that police noticed two Bolero vehicles coming and on seeing police, the drivers of the two vehicles tried to escape. Then police apprehended one driver while the other succeeded. On interrogation, A1 to A3 disclosed their identity particulars and police found 810 kgs of ganja in their possession. Then police apprehended them and seized the ganja and after observing all formalities, they were remanded to judicial custody. 5. Heard. Perused the record. 6. Learned Assistant Public Prosecutor submits that the contraband involved is huge quantity i.e. 810 kgs and investigation is not completed and some more witnesses are to be examined and prays to dismiss the criminal petition. 7. Learned counsel for the petitioners contend that the petitioners are arrested on 12.12.2024 and since then they are languishing in jail and prays to allow the petition. 8. After careful observation of the material on record and submissions made on behalf of both sides, as the contraband involved in this crime is huge quantity i.e. 810 kgs and as the petitioners are remanded to judicial custody on 12.12.2024 itself and the allegations made against the petitioners are grave in nature, this Court is not inclined to consider the criminal petition at this stage. 9.
