The petitioner has filed the second petition under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 with a prayer to grant regular bail to him in case FIR No.590, dated 27.09.2023, registered under Sections 506,34,323, (325 and 307 of IPC added later on), at Police Station City Mandi Dabwali, District Sirsa, Haryana (Annexure P-1). 2. The FIR in the present case was registered on the basis of the statement made by Tushar son of Subhash Sharma and the same has been reproduced below:- Statement of Tushar Son of Subhash Sharma resident of Kabir Basti, Mandi Dabwali aged about 22 years Mob. No. 7888446970, stated that i am resident of aforesaid address and I am an agriculturist. We are two siblings. I have an elder sister namely Komal and I am younger to her. I am 9th class pass. On 24.08.2023 at about 2 pm I visited at a barber shop for having haircut, situated at Mallaut road, under the flyover in mandi Dabwali. At that time, three persons namely Lovepreet Singh HITESH 2025.08.19 09:30 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh CRM-M-43493-2025 -2 Simranjeet s/o Jagjeet Singh resident of Killianwali armed with iron rod, Angad s/o Rinku resident of Killianwali armed with wooden phatti and Manpreet Singh father name and address not known armed with wooden danda, were arguing with my friend Shubham Sharma s/o Vijay Sharma resident of Killianwali. So, I tried to persuade Lovepreet Singh @ Simranjeet, Angad and Manpreet Singh to stop the argument between them but they got furious and Lovepreet Singh @ Simranjeet gave a blow with iron rod at my head which lended on my forehead and then Manpreet also gave a danda blow which hit at the back of my head. Thereafter, Angad also gave fatti blow towards my head but I raised my left arm to save myself, so the said fatti blow hit on the fingers of my left hand. Thereafter, I fell on the ground. Lovepreet Singh @ Simarjeet, Angad and Manpreet Singh gave several blows on various parts of my body. Then, I raised alarm for help. My uncle Jaswinder Singh So Mohanlal R/o Kiliyanwali came there and spotting the arrival of my uncle Jaswinder at the spot, the assialants Lovepreet Singh @ Simranjeet, Angad and Manpreet Singh along with their weapons fled away from the spot and while leaving they extended threat of life to me. Then my friend Subham and my uncle Jaswinder has taken me to Government Hospital, Dabwali, after arranging a vehicle but the concerned Doctor had referred me to higher centre as I had sustained multiple injuries and then my family members shifted me to Max Hospital, Bhatinda, where I remained admitted and i was not conscious. Now, I havereturned home after being discharged from the hospital. Today, I have visited the Police Post and got recorded my statement to you. I have told the truth to you that the injuries were caused to me in Ward no. 1, Gali no. 2, Mandi Dabwali by Lovepreet Singh @ Simranjeet, Angad and Manpreet Singh without any reason. A quarrel with my other friends had taken place in punjab and someone on the spot had told that the incident took place in Punjab, due to which your goodself had sent the ruqqa to Police. Learned counsel for the petitioner contends that as per the case of the prosecution, the petitioner was allegedly armed with an iron rod and caused an injury on the head of the complainant. He further contends that the petitioner is a young boy aged about 22 years and is in custody since 04.01.2024. After completion of investigation, challan has already been presented before the competent Court of law. He next contends that the injured in the present case has already been discharged long ago. During the course of trial, only 03 witnesses out of total 15 witnesses have been examined so far. Thus, further custody of the petitioner will not serve any meaningful purpose. 4. On the other hand, learned State counsel has vehemently opposed the submissions made by learned counsel for the petitioner on the ground that serious allegations have been levelled against the petitioner and he does not deserve the concession of bail by this Court. 5. I have heard the learned counsel for the parties and perused the record carefully. 6. In the present case, the petitioner is stated to be in custody for the last about 01 year and 07 months. Further, Tushar, injured has already been discharged from the hospital and the prosecution has already been examined only 03 witnesses in totality. Thus, conclusion of the trial may take quite a long time. 7. Without commenting on the merits of the case, the present petition is allowed.
