CORAM: HON'BLE MR. JUSTICE B M SHYAM PRASAD and HON'BLE MR. JUSTICE T.M.NADAF
ORAL ORDER
(PER: HON'BLE MR. JUSTICE B M SHYAM PRASAD)
This petition is as against the Order dated 19.06.2025 by the Karnataka State Administrative Tribunal [for short, 'the Tribunal'] in Application No. 1194/2025. The Tribunal, by this impugned order, has refused to interfere with the petitioner's grievance with the decision to transfer her.
Sri Vardhan Shenoy K, the learned counsel for the petitioner, while delineating the circumstances that precede the petition and the order dated 19.06.2025 which is called in question with the Tribunal in Application No.1194/2025, submits that the third respondent has been removed from the position that he held and another person is posted, but the petitioner's apprehension is if that order is to be challenged without succeeding in the present

petition, the petitioner could be non-suited only because this petition is disposed of without liberty.
Sri Vikas Rojipura, a learned Additional Government Advocate, who is called upon to accept notice for the first and second respondents, and Sri Nagaraj S Jain, the learned counsel who is permitted to take notice for the third respondent, are heard.
This Court is of the view that, in the turn of events, if the petitioner can make out a cause, the Tribunal, notwithstanding its observation must decide on the petitioner's grievance as this Court has not decided on the petitioner's grievance with its
order. The petition stands disposed of accordingly.
