The Petitioner has filed this CRLMC challenging the order dated 06.12.2025 passed by the learned JMFC-III (Cog.Taking), Cuttack. He further sought for a direction from this Court to the Opposite Party to release the HP laptop bearing Batch No. 5CD2468ZQY in her favor 3. Learned counsel for the Petitioner submits that the Petitioner has filed an application under Section 503 of BNSS, 2023, which has been registered as Crl. Misc. case No.118 of 2025 arising out of G.R. Case No. 165 of 2025, claiming herself to be the owner of one HP laptop bearing Batch no.5CD2468ZQY and the said laptop is in running Digitally Signed Signed by: GITANJALI NAYAK Reason: Authentication Location: OHC Date: 21-Jan-2026 18:27:27 Signature Not Verified Page 2 of 2. condition, which was seized in CID CB P.S Case No 09 of 10.03.2025. After seizure, the laptop is lying unused and deteriorating, which serves no purpose of justice, especially when the data therein can be cloned/mirrored by the I.O. for investigation. The learned court below, who was in seisin of the aforesaid Crl. Misc. case No. 118 of 2025 vide order dated 06.12.2025 rejected the Criminal Misc. Case Application of the petitioner. 4. Considering the prayer made by the learned counsel for the Petitioner for release of the laptop, this Court is of the view that as the son of the petitioner is a student of MBA and the laptop is being used for study of MBA course, the Petitioner has become handicapped to study the MBA. 5. In such view of the matter, the authority is directed to release the laptop of the petitioner after forensic examination within a period of seven months from today. 6.
