HC-KAR NC: 2025:KHC:50786 WP No. 21306 of 2025
THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ
ORAL ORDER
1. Learned AGA accepts notice for respondent Nos.1 to 4. 2. Notice to respondent No.5 is dispensed with in view of the proposed order to be passed. 3. Petitioner is before this Court seeking for the following reliefs:
"1.
directing the Respondents 1 to 4 to investigate into the complaints dated 18.01.2024, 29.02.2024, 20.01.2025, 05.02.2025, 26.03.2025 and 12.06.2025 produced at Annexures 'A to F' Without any further delay and further issue a writ or direction directing the respondents 3 and 4 to provide adequate safety and security to the lives and property of the petitioners at the hands of the respondent No.5 and his associates and to pass such other relief/s as this Hon'ble Court deems fit in the circumstances of the case, in the interests of Justice and Equity."
4. By way of the complaints at Annexures-A to F above, what the petitioner has sought for was for respondent Nos.3 and 4 to take action against respondent No.5 from interfering with the possession of the property of the petitioner and threatening the petitioner. - 4 -
HC-KAR NC: 2025:KHC:50786 WP No. 21306 of 2025
5. On enquiry as to whether any civil suit had been filed by the petitioner, learned counsel for the petitioner fairly submit that no such suit had been filed. 6. If no suit has been filed, the question of filing a complaint before the jurisdiction police authorities seeking for them to take action to restrain respondent No.5 interference would not be permissible since police authorities are not permitted to intervene in civil disputes. 7. In that view of the matter, reserving liberty to the petitioner to file appropriate civil proceedings seeking for injunction or otherwise and if such order is passed to seek for police protection and then approach the police authority, the petition stands disposed of.
