He has been transferred from GIC, Dhanikot, Nainital to GIC, Aambag, Champawat, vide order dated 26.6.2023. Petitioner has challenged the said order in this writ petition seeking the following reliefs: “i- A writ, order or direction in the nature of certiorari to quash the impugned order dated 26.06.2023 (Annexure No. 6 to the Writ Petition) qua the petitioner. ii- A writ, order or direction in the nature of mandamus commanding the Respondents to consider claim of Petitioner for transfer against available or resultant vacancies in district Almora as per the option given by the petitioner in exercise of powers under section 13 of the Act of 2017 and allow him to remain posted in the present place of posting and to pay all consequential benefits till a final decision ins taken in his application.” (3) During the course of argument, Mr. Sanjay Bhatt submits that he is not pressing prayer no. (i). He submits that since petitioner is serving at durgam places for more than 20 years, therefore, he is entitled to be transferred to a sugam place. (4) This Court cannot issue any 2025:UHC:9257 direction to the competent authority to transfer the petitioner at a particular institution. If petitioner has any grievance regarding his transfer/posting, then he can make a representation. (5) Writ petition is, accordingly, disposed of with liberty to the petitioner to make representation. If he makes representation within two weeks from today, competent authority shall consider his request and pass appropriate order, as per law, within six weeks thereafter.
