THIS APPEAL, COMING ON FOR ORDERS, THIS DAY,
JUDGMENT WAS DELIVERED THEREIN AS UNDER:
CORAM: HON'BLE MR. VIBHU BAKHRU ,CHIEF JUSTICE and HON'BLE MR. JUSTICE C M JOSHI
ORAL JUDGMENT (PER: HON'BLE MR. VIBHU BAKHRU,CHIEF JUSTICE)
1. The appellant has filed the present appeal, impugning an
order dated 27.03.2025 [impugned order] passed by the learned Single Judge in Writ Petition No.54525 of 2016 (KLR-RES).
2. The said petition was filed by the appellant, impugning an
order dated 14.06.2012 whereby, the appellant's revision under Section 56 of the Karnataka Land Revenue Act, 1964 was dismissed by the Joint Director of Land Records. The learned Single Judge examined the order dated 14.06.2012, which was impugned in the writ petition, and found that the Revisional Authority [JDLR], had noted down the rival contentions but had not provided any reason for agreeing or disagreeing with the
contentions of the parties. In view of the finding that the order of the Revisional Authority was not informed by reason, the said order was set aside and the matter was restored before the Revisional Authority, to decide afresh.

HC-KAR NC: 2025:KHC:29861-DB WA No. 720 of 2025
3. The learned counsel appearing to the appellant has sought to advance submissions on the merits of the controversy. However, it is clear that the same has not been considered by the learned Single Judge. The court has not rendered any observations in respect to the merits of the dispute. The learned Single Judge has remanded the matter – in our view rightly so – to the Revisional Authority to decide afresh. In our view, no interference with the impugned order is warranted.
4. The appeal is, accordingly, dismissed. We however, request the Revisional Authority to consider the revision and pass an order, as expeditiously as possible. Needless to state that the Revisional Authority shall consider all material that has been placed on record, before passing the order.
5. Pending applications stand disposed of.
