JUSTICE R.K. PATTANAIK Order No. ORDER 30.04.2025 01. 1. Heard Mr. Mohanty, learned counsel for the petitioner. 2. No notice is issued to the opposite party as the matter is disposed of at the stage of admission. 3. Instant petition is filed by the petitioner for a direction to the Sub-Registrar, G. Udayagiri to comply the order dated 21st November, 2023 of learned Senior Civil Judge, G. Udayagiri in connection with E.P. No.01 of 2023 for the reason stated. 4. Referring to the order dated 21st November, 2023, Mr. Mohanty, learned counsel for the petitioner would submit that the original sale deed with the case record was sent to the Office of the Sub-Registrar, G. Udayagiri for registration of the same but it is pending since then. The submission is that no prompt steps have been taken by the learned Court below to ensure early registration of the sale deed by the Sub-Registrar, G. Udayagiri, hence, a direction is required to be issued in that regard. 5. A copy of the judgment in C.S. No.11 of 2010 is at Annexure-1 and the same is perused. In fact, the petitioner is the decree holder and he obtained the decree against the opposite party towards specific performance of a contract with the execution of a sale deed in his favour, which is pending in connection with E.P. No.01 of 2023. Having regard to the above facts and submission of Mr. Mohanty, learned counsel for the petitioner, in view of the judgment and decree in C.S. No.11 of 2010 and as the execution of the sale deed is to be through the process of the court pending for long, the Court is of the view that a direction is required to be issued to the concerned Sub-Registrar, who has received the record for the said purpose in connection with E.P. No.01 of 2023 as the same would serve the purpose and meet the ends of justice. 6. Hence, it is ordered. 7. In the result, the CMP stands disposed of with the direction as aforesaid to be complied with by learned Sub-Registrar, G. Udayagiri to ensure registration of the sale deed received by him along with the case record in E.P. No.01 of 2023 and to accomplish it as soon as possible preferably within a period of one month from the date of receipt of a copy of this order. 8.
