It is not maintainable and the forum accepting the complaint, has acted without jurisdiction. 2. Mr. Raj Mohan Upadhyay, learned advocate, Additional Chief Standing Counsel appears on behalf of State. 3. We do not deem it necessary to direct issuance of notice on private respondent no.3 (the complainant). Instead, petitioner is directed to raise his objection on maintainability of the proceeding, before the forum. For the purpose he has liberty to enclose our order in his objection. 4.
