Heard counsel for the petitioner, Mr. Avinash Chandra Srivastava, learned counsel for respondent- Gaon Sabha and Mr. T.P. Gupta, learned Standing Counsel for the State respondents. 2. The instant public interest litigation has been filed for the following relief:- "Issue a writ, order or direction in the nature of mandamus directing and commanding the respondent nos. 2,3 and 4 to evict to the respondent no.6 from the land (gata No. 1768, 1769, Kisni Mainpuri) in question and recover the damages within stipulated period." 3. Counsel for the petitioner submitted that in view of the entry of the plot in question, the appropriate direction be issued for eviction of the private respondents from the plot in question. 4. Learned Standing Counsel for the State respondents and counsel for respondent- Gaon Sabha submitted that proceeding under Section 67 (1) of the U.P. Revenue Code, 2006 has already been registered as case No. T202401490404108 against the persons who are in possession over the same which shall be decided in accordance with law. 5. Counsel for the petitioner submitted that appropriate direction be issued for expeditious disposal in the aforementioned cases. 6. Considering the facts and circumstances of the case, the public interest ligation is finally disposed of with direction to respondent no.4, Tehsildar, Tehsil Kisni, District Mainpuri to decide the aforementioned pending case No. T202401490404108 expeditiously after affording opportunity of hearing to both the parties.
