The Court made the following Order: The petitioner is arraigned as Accused No.2 in C.C.No.214 of 2023, on the file of the learned Judicial Magistrate of I Class, Punukonda, Anantapur District.
2. The petitioner is alleged to have committed an offence under Section 498-A read with Section 34 of the Indian Panel Code, 1860 (for short ‘IPC’) along with the accused No.1.
3. The petitioner is the brother of the accused No.1 and respondent No.2 was married to the brother of the petitioner. On
2 account of certain marital disputes, the respondent No.2 filed a complaint before Somandepalle Police Station, Anantapur District and Crime No.27 of 2022 was registered against the named accused. After investigation, the police filed a charge sheet and the same has been taken on file as C.C.No.214 of 2023 on the file of the learned Judicial Magistrate of I Class, Penukonda.
4. The learned counsel for the petitioner submits that, except for vague and frivolous allegations, there are no specific allegations against the petitioner. It is further submitted that the petitioner is working in Bangalore as a software engineer and has never resided at the place where the accused No.1 and respondent No.2 resided. The learned counsel submits that, the allegations are completely vague and would not withstand the scrutiny of the trial.

This Court, without going into the merits of the matter, deems it appropriate to dispose off the criminal petition by dispensing with the presence of the petitioner, subject to the condition of the petitioner submitting an undertaking to the learned Judicial Magistrate of I Class, Penukonda, Anantapur District, to appear as and when directed by the learned Magistrate.
