JUSTICE LALITHA KANNEGANTI Digitally signed by MEGHA MOHAN Location: HIGH COURT OF KARNATAKA - 2 - HC-KAR NC: 2025:KHC:26372 WP No. 17625 of 2024 ORAL ORDER Aggrieved by the order passed in I.A.No.4 in Crl.Misc.No.467/2023 dated 20.02.2024 by the III Additional Principal Judge, Family Court, Bengaluru, whereby the Family Court had granted maintenance of an amount of Rs.2,000/- each per month to the children and an amount of Rs.1,000/- per month for the respondent/wife and altogether an amount of Rs.5,000/- is granted, the petitioner/husband is before this Court. 2. The parties are referred to as husband and wife for the sake of convenience. 3. Learned counsel appearing for the husband submits that the husband is working as plumber and he has no sufficient income and he is not in a position to pay the maintenance. 4. Learned counsel for the wife submits that the husband is having landed properties and from the last ten years, the wife is taking care of the children and the husband is not contributing anything. - 3 - HC-KAR NC: 2025:KHC:26372 WP No. 17625 of 2024 5. When this matter came up on the last occasion, this Court had asked the advocates to explore the possibility of settlement. Today, the parties are present before this Court and learned counsel for the husband submits that the husband is ready to give two properties worth an amount of Rs.35 lakhs. 6. Learned counsel for the wife submits that the wife is not interested for the same and she wants money and the husband is having landed properties. 7. This Court is not able to understand, when the husband is ready to give the properties worth Rs.35 lakhs to the wife and when the maintenance that is awarded is an amount of Rs.5,000/- per month to the wife and the children, the wife has not even filed the petition for enhancement of maintenance and she is not agreeing for the said settlement. Be that as it may, in the considered opinion of this Court, the order passed by the Family Court is a well considered one. For two children and the wife, granting an amount of Rs.5,000/- per month is not an excessive amount irrespective of what the husband is doing. In that view of the matter, this Court finds no - 4 - HC-KAR NC: 2025:KHC:26372 WP No. 17625 of 2024 reason to interfere. Hence, this Court is passing the following order: ORDER i.
