Heard learned counsel for the petitioners, learned Standing Counsel for the State-respondents, Mrs. Varsha Chauhan- the petitioner no.1- and perused the records. 2. In brief, the petitioners’ case is that both the petitioners are of marriageable age and have solemnized marriage on 8.8.2024 at Arya Samaj, Krishna Nagar, Prayagraj without consent of petitioner no.1’s family. It is stated in affidavit that the petitioner no.2 was unmarried at the time of solemnization of marriage with the petitioner no.1. 3. On the last date of hearing, the Court directed the S.H.O. of Police Station Uttar, District Agra to file a verification report verifying the contents mentioned in the petition and the documents annexed. The petitioners were also directed to appear in person along with respondent no.4- the father of petitioner no.1. 4. In police verification report, it’s unfolded that the petitioner no.2 has already been married in the year 2018 with one Kusum d/o Man Singh, r/o Barkatpur, P.S. Rasoolpur, District Firozabad and a girl child has also born out of the said wedlock. 5. Today, when the matter was called for hearing, the petitioner no.1 appeared in person and revealed that she was kept in dark by the petitioner no.2 about his first marriage with Smt. Kusum, and also stated the act of deceit and cruelty perpetuated by the petitioner no.2 against the petitioner no.1. Therefore, her statement was recorded in Court and the same are reproduced herein below: 1 of 2 “मेरा नाम वर्षाा चौहान है। मेरे पिता का नाम अवधेश कु मार है, मैं पिनवासी- सुभार्षा कॉलोनी, बल्लभगढ़, फरीदाबाद, हरिरयाणा- पिन कोड-121004 है। मैंने बोशेंद्र वमा के साथ शादी पिदनांक 08.08.2024 को आय समाज, कृ ष्ण नगर, प्रयागराज में पिकया, शादी के समय मुझे यह ता नहीं था पिक बोशेंद्र की हली शादी हो चुकी है, जिजसकी जानकारी मुझे मेरी शादी के दो माह बाद ता चली। जब मैंने इस बात का पिवरोध पिकया पिक तुमने मुझसे झूठ बोल करके शादी पिकया है, तब उसने मुझे मेरे साथ मारीट की और नींद की दवाइयाँ खिFलाई ं और रोज मुझे सुला करके नींद की दवाइयाँ देता था। अगर मैं नहीं Fाती थी, तो वह मुझे मारता-ीटता था। दवा के डोज की वजह से मैं सोती रहती थी। दवा की डोज ज्यादा होने के कारण मुझे रात में अचानक उल्टी होने लगी, जिजससे मेरे मुँह से Fून भी पिनकलने लगा था, जब मैंने उसे फोन पिकया, तो वह अनी हली वाली वाइफ के घर र था, तो उसने मुझे फोन से बोला, सो जाओ, मैं तुम्हें सुबह पिदFाउँगा। इसके कु छ समय बाद मैंने अनी मकान माखिलक से कहा पिक मेरी मम्मी को फोन कर दो, जब उन्होंने फोन पिकया, तो मेरी मम्मी आयी और पिफर हॉस्पिQटल ले जाकर भतR पिकया गया, जिजससे मैं तीन पिदन आई.सी.यू. में भतR रही और चार पिदन वाड में भतR रही। इसके बाद मैं अनी माता के साथ आयी और पिकराये के मकान में एक पिदन रही, पिफर इसके बाद मैं अने घर चली गयी। मैं शादी के दो माह बाद ही गभ वती होने की बात बतायी, तो लड़के ने मुझे कई बार मुझे दूध में हल्दी डालकर पिलाया, घी खिFलाया, जिजससे पिक मेरा गभ ात हो सके । लेपिकन मेरा गभ ात नहीं हो सका। लेपिकन कु छ पिदन बाद दवा का डोज देता रहा, जिजससे मेरी पिबना मजR के कु छ पिदन बाद मेरा गभ ात हो गया, जिजससे मुझे Fून आता रहा। मुझे इस बात का Fतरा है पिक वह मेरी मम्मी से बोला पिक हम तुम्हें गुंडे से मरवा देंगे, इसखिलए मुझे आकी सहायता चापिहए। इसखिलए हमें सुरक्षा (Protection)Protection)) चापिहए।" 6. In view of the statement of petitioner no.1, the Commissioner of Police, Agra is directed to register an FIR against the petitioner no.2 and all those individuals or group of person involved in fake solemnization of marriage and issuance of invalid marriage certificate. The role of witnesses to the marriage certificate; Smt. Deepa and Smt. Anita and Santosh Kumar Shashtri, Purohit shall also be investigated in solemnization of sham marriage. The statement of the victim before the learned Magistrate may also be recorded at the earliest. 7. A compliance report be filed before the learned Chief Judicial Magistrate, Agra within one week of the registration of the FIR along with the investigation carried out during this period. The learned Chief Judicial Magistrate, Agra is directed to supervise the investigation to ensure that the real culprits have been charged with and justice has been done to the petitioner no.1. 8.
