By means of this application, the applicant-complainant is seeking transfer of Sessions Trial No.410 of 2021 (State v. Pramod Kumar), arising out of Case Crime No.543 of 2020, from Orai to Etawah solely on the ground that the opposite party no.2- accused being an influential person is threatening the complainant. Adjournment has been sought on behalf of learned counsel for the applicant. Learned counsel for the opposite party and learned AGA for the State are present. The prayer for adjournment is declined. During the course of hearing, it is stated by learned counsel for opposite party no.2 that the accused never misused the concession of regular bail and no grievance in this regard has ever been made by the complainant before the trial court. The trial is pending since 2021 and the averment regarding threats are vague. No exceptional ground is made out for transfer of the trial. The application is, accordingly, dismissed.
