JUSTICE JAYANT BANERJI) Despite the appeal being called up twice, learned counsel for the appellant has not appeared. 2. Learned counsel for the respondent who is present in Court today has filed a memo for production of documents. This memo encloses a photocopy of the certified copy of the order sheet of 05.01.2022 in C.Misc.No.334/2017 in the Court of the Additional Civil Judge and JMFC, Gubbi, whereby, the petition is dismissed in terms of the joint memo filed by the - 3 - HC-KAR NC: 2025:KHC:53393-DB MFA No. 3218 of 2019 parties. A photocopy of the joint memo dated 05.01.2022 has also been brought on record. 3. It appears from the perusal of the copy of the joint memo filed by the petitioner and the respondent therein in C.Misc.No.334/2017 that the wife has agreed to receive permanent alimony of Rs.7,00,000/-. She has also agreed not to file any case against the respondent for maintenance or for partition or any other case. The number of the instant appeal (MFA No.3218/2019) also finds a mention therein. 4. The instant appeal is filed challenging the judgment and decree dated 14.03.2019 passed in M.C.No.108/2017 on the file of the I Additional Principal Civil Judge, Family Court, Tumakuru. By means of the petition filed by the husband under Section 13(1)(ia) of the Hindu Marriage Act, 1955, the appellant had sought for dissolution of the marriage. By means of the impugned judgment and decree dated 14.03.2019, the petition was allowed, and the marriage between the parties registered on 08.12.2025 and solemnized earlier on 29.11.2015, was dissolved. - 4 - HC-KAR NC: 2025:KHC:53393-DB MFA No. 3218 of 2019 5.
